1. Acceptance of Terms

By accessing or using the Trailfire platform ("Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

2. Account Terms

To use Trailfire, you must:

  • Be at least 18 years of age
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Be a human -- accounts registered by automated methods are not permitted
  • Accept responsibility for all activities that occur under your account

You may not use the Service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction. Your use of the Service is also governed by our Acceptable Use Policy.

3. API Usage

Access to the Trailfire API is available on qualifying plans. By using the API, you agree to the following:

  • You will not abuse or overload the API with excessive requests
  • Rate limits apply based on your subscription tier
  • You will not use the API to build a competing product
  • API access may be revoked if these terms are violated
  • We reserve the right to modify or discontinue API features with reasonable notice

4. Payment Terms

Paid plans are billed in advance on a monthly or annual basis and are non-refundable except as required by law. All fees are exclusive of taxes, which you are responsible for paying.

  • Prices are subject to change with 30 days' notice
  • Downgrading your plan may result in the loss of features or capacity
  • Failure to pay may result in suspension or termination of your account
  • Additional charges for postcard campaigns and ad spend are billed separately based on usage

5. Termination

Either party may terminate this agreement at any time. You may cancel your account from your account settings or by contacting support. Upon cancellation:

  • Your access to the Service will continue until the end of your current billing period
  • We will retain your data for 90 days, after which it will be permanently deleted
  • You may request an export of your data before deletion

Trailfire reserves the right to suspend or terminate your account at any time for conduct that we determine, in our sole discretion, violates these Terms, our Acceptable Use Policy, or our SMS & Email Consent Policy, or is harmful to other users, us, or third parties, or for any other reason.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Trailfire and its suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

In no event shall our aggregate liability exceed the greater of one hundred dollars ($100) or the amount you paid Trailfire for the Service in the twelve months prior to the claim.

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Travis County, Texas.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
